Product Descriptions and Guarantees
Description and Specification of Products
While we endeavour to ensure that the information and content of this website is fair and accurate, we cannot guarantee the completeness of the material covered. We are constantly striving to improve our services and products. We reserve the right to make improvements and changes to product design, descriptions, prices, specifications and any other content without notice. While we are constantly striving to ensure material is up-to-date, we make no assurances that the information is current.
Product Finishes
As wood is a natural product, no two pieces are identical. By placing an order with us you acknowledge that individual products and/or parts within a product will differ in regards to the shade and grain of wood used. Due to print limitations actual colour/finish may differ slightly from that seen on ETB Furniture Limited printed materials and brochures etc. We reserve the right to change any and all materials and/or parts used in the manufacture of our products without notice. Actual colours you view on this site will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.

Furniture Guarantees
All furniture manufactured by ETB Furniture Limited is supplied with a 24 month guarantee from the date of delivery. This guarantee covers products under normal/typical usage and storage conditions. If we are advised that a product has a fault within our guarantee period, the decision as to whether a product has been damaged under normal usage and storage conditions lies solely with us. If a product has been deemed damaged intentionally or through misuse we reserve the right to terminate the guarantee and are not liable for the cost of repair or replacement of the product. We accept no liability and guarantees are void if goods are not paid for by the due date.
Mattress Warranty
ETB mattresses come with a 60 month warranty against faults. Any products which suffer from either poor workmanship or manufacturing defect within the first 12 months will be replaced free of charge by our supplier, subject to the following. After 12 months a sliding scale of usage charge will be made against the sale price in operation at the time of your order: 12-24 months 20% charge, 25-36 months 40% charge, 37-48 months 60% charge, 49-60 months 80% charge. This warranty covers products under normal/typical usage and storage conditions. If we are advised that a product has a fault within the warranty period, the decision as to whether a product has been damaged under normal usage and storage conditions lies solely with ETB Furniture Limited and our suppliers. If a product has been deemed damaged intentionally or through misuse we reserve the right to terminate the warranty and are not liable for the cost of repair or replacement of the product.
Availability, Pricing & Payment
Product Availability
Product availability is listed on our site in the form of ‘In Stock’ or ‘Made to Order. While our stock information is updated regularly, a product should not be considered in stock until an order confirmation has been received. ETB Furniture Limited will not be liable to pay any compensation and/or losses incurred as a result of an item being unavailable after an order is placed.
Pricing
Any prices and charges that are displayed in Sterling on our price lists or website are exclusive of VAT and may be subject to change without notice. In the case of individual quotations, prices are typically valid for 30 days unless otherwise stated. We reserve the right to charge interest on any amount outstanding beyond this time at a rate of 1.5% above the current bank of England Base Rate. Your contract and purchase agreement is your order confirmation, we are obliged to supply the products listed at the prices shown on this document only. Unless stated, all prices quoted do not include delivery, assembly or installation.
Delivery of 15 furniture items or more is free of charge throughout mainland UK.
Deliveries of less than 15 items will incur a charge.
VAT will be charged on all goods and services.

All orders are subject to our Terms and Conditions. On receipt of an order we will send an acknowledgement via post or e-mail. It is the customer’s responsibility to check that their order is correct on receipt of the acknowledgement and inform us immediately of any discrepancies.
We reserve the right to refuse any order for any reason at our sole discretion. We will not be liable to you for our refusal to process an order, or for withdrawing or editing any products listed on our website after an order has been placed.
Orders are placed on account. For establishments not financed by the government, it may be necessary to perform a credit check prior to account approval. In the case of new Customers a pro-forma system may be introduced at the discretion of ETB Furniture Limited. Pro-forma invoices are due for immediate payment. Account orders will be invoiced on the date of delivery and are due for payment within 30 days. We reserve the right to charge interest on overdue accounts.
Payments can be made via BACS, cheque or by most major credit or debit cards.
Goods remain the property of ETB Furniture Limited until paid for in full and we reserve the right to gain access to a Customers premises to retrieve goods should payment not be made in full. In the event of a customer going into receivership or liquidation, any outstanding amount is due immediately and ETB Furniture Limited may at any time enter the customers premises to recover any delivered goods that have not been paid for in full.
The customer shall only be at liberty to sell the goods purchased from ETB Furniture Limited prior to the passing of title on the understanding that if the customer does sell the goods then the customer will hold on trust for ETB Furniture Limited so much of the proceeds of the sale received by the customer under contracts which includes any of the goods either in their original or altered state as are necessary to discharge payment in full to ETB Furniture Limited.
Customs
The ETB Furniture Limited website has been designed for use by Customers based in the UK. Customers who are based in Europe should contact our head office prior to placing an order. International delivery fees are calculated on an individual basis. When ordering goods for delivery overseas you may be subject to import duties and taxes, which are levied once a delivery reaches it’s destination. You as the customer are responsible for these charges and as the importer you are also responsible for complying with the laws and regulations of the country in which you are receiving the goods, and where applicable accept that we have no control over cross-border deliveries that are subject to inspection by customs.
Delivery and Installation
Delivery – General
Delivery of 15 furniture items or more is free of charge throughout mainland UK. Deliveries of less than 15 items will incur a charge.
It is assumed that delivery will be to one location with suitable vehicular access. Smaller deliveries are made by our team in ETB vehicles. Some large deliveries are contracted out to approved haulage firms with whom we have long standing relationships. During delivery all furniture is blanket wrapped to ensure it arrives in good condition. We choose blanket wrapping as opposed to plastic or other materials which can only be used once and typically damage the environment in their creation.
The majority of our furniture is delivered intact with the exception of beds & lockers (delivered in blocks of 2-6), all measurements and specifications of products are provided on our website or during the ordering process. Our furniture is designed to fit through average doorways and upstairs etc. If a customer’s premises such as stairways, doorframes, ceiling heights, or other structural parts are of an awkward or smaller than average size, it may be necessary to make adjustments to an order prior to delivery. Providing we are advised of these potential complications when your order is placed, we will make these adjustments free of charge. Where our free of charge design service has not been utilised, customer’s are responsible for making sure that all furniture items and parts are able to pass through the route from our delivery vehicle to the room concerned and that the furniture ordered will fit in the room it is intended for. Should we have to return the goods for exchange or modification, a further delivery charge may be required in order to return the furniture to you. If you are unsure about access to your premises or about correctly and accurately measuring a room for furniture, please contact our head office for guidance, or request a visit by one of our team.
Delivery – Timescales & Scheduling
We hold some stock of standard catalogue items which can usually be delivered quickly. For non-stock, out of stock, bespoke items and large orders, delivery timescales will vary. Should an order contain a mixture of in-stock, non-stock and/or bespoke items, the delivery timescale will reflect the product with the longest lead time. We may part deliver some orders. Various factors are considered when estimating delivery timescales such as: the delivery address, the complexity of the items ordered, the volume of items ordered, current order levels etc. While we attempt to meet delivery estimates and requested dates, these do not form a term of the contract unless otherwise agreed in writing.
Spare parts and smaller items may be delivered by Royal Mail or other approved courier services.
We attempt to give at least seven days’ notice before the arrival of your delivery. Furniture deliveries take place Monday to Friday between the hours of 8am and 6pm and are typically scheduled once your items have been manufactured to completion and checked for defects. We will contact you in advance of a delivery to advise of the estimated date and where possible, time of the delivery. ETB Furniture Limited will accept no responsibility for any loss or damage due to delivery delays. We reserve the right to charge a re-delivery fee should the initial delivery attempt fail or should the delivery be refused without reason.

Distribution and Assembly
In order to keep costs to a minimum we understand that many of our customers choose to have their own maintenance staff unload, distribute and assemble the furniture we supply. For this reason, our delivery service is typically operated by one driver who will deliver items to the back of the delivery vehicle. Our beds are designed for straight forward assembly, fittings and instruction sheets are provided as standard. ETB Furniture Limited accept no liability in respect of any injury, to any person, as a result of lifting/moving furniture following delivery at a customers premises.
A distribution and assembly service is available to all customers on request. ETB never subcontract fitting work to other companies. We only use our own craftsmen and joiners for fitting work, all of whom pay special care and attention to customer’s premises.
Due to the demand for this service, we would recommend informing us of your requirements as soon as possible.
Our insurance and health and safety policies/regulations insist that staff carrying and/or assembling furniture must be wearing appropriate footwear to protect them while they work. We regret that staff will be unable to remove their shoes while working at your premises. Some Customers choose to provide protective floor coverings if necessary.
Once again, where our free of charge design service has not been utilised, customer’s are responsible for making sure that all furniture items and parts are able to pass through the route from our delivery vehicle to the room concerned and that the furniture ordered will fit in the room it is intended for. Should we have to return the goods for exchange or modification, a further delivery charge may be required in order to return the furniture to you. Storage of Goods
We reserve the right to make additional charges for the storage of goods if after your order has been placed we are requested to hold goods for an extended period.
Events beyond our control
Force Majeure: We shall have no liability to Customers for any failure or delay in the delivery or any damage or defect to goods supplied hereunder that is caused by an event or circumstance that is beyond our reasonable control.
Cancellations and Returns
Cancellations
Prior to shipping, any cancellations of furniture orders must be made as soon as possible in writing to our head office or by e-mail. In the case of bespoke or non-stock items it is not possible to cancel an item/s once manufacture has commenced. In the case of stock items, if an item has already been dispatched, please follow the guidelines for returning items.
Furniture Returns – Damaged or Defective Items
All goods must be checked and signed for on receipt of delivery, we shall not accept claims for missing, faulty of damaged goods if the delivery note is signed un-checked. Should an item of furniture be delivered damaged or defective, we must be informed as soon as possible and within a maximum of 7 days after delivery. We will then look to replace the item at our earliest convenience. The responsibility of determining whether an item is damaged or defective lies solely with ETB Furniture Limited. We reserve the right to refuse to replace any item that has been misused or tampered with after delivery. Items must be returned in their entirety and in their original packaging. We reserve the right to refund a proportion of the price of the goods instead of replacing goods should a customer agree.
Furniture Returns – Other Reasons
Stock Items – As per the delivery section of these terms and conditions, all goods must be checked and signed for at the point of delivery. Should you inform us that you are not satisfied with your order after delivery, we reserve the right to apply a fee, for the collection of any items. Any collections will be made at our convenience, items must be unused and returned in their entirety and in the same state and packaging in which they were delivered.
Non-Stock and Bespoke Items – cannot be cancelled, amended or returned once manufacture has commenced.
Mattress Returns
It is important that all mattresses are thoroughly checked and you are sure that you are completely satisfied with the product at the point of delivery. Due to the nature of this type of product and UK health and safety regulations, we are unable to replace or refund mattresses for any reason other than what is stipulated in the warranty unless it is mentioned at the time of delivery. Under no circumstances can mattresses be returned or replaced after being left at a Customers premises for health and safety reasons.
Use of Website and General
Website Service and Access
ETB Furniture Limited attempt to ensure the smooth running and availability of this website at all times however, due to the nature of the internet uninterrupted service is not guaranteed.
Occasionally it will be necessary for us to complete essential maintenance to this site. At these times, we will do our utmost to insure minimal disruption to our Customers.
ETB Furniture Limited’s website must not be used by you in a way that is likely to cause interruption to its service, or cause damage to its content or functions.
Account registration and Orders
This website must not be used for any fraudulent or illegal purposes. The registration of a new account with ETB Furniture Limited must be made by a single user only who is authorised to act on behalf of the organisation they represent. As this user, you are solely responsible for the security of any passwords issued and are not permitted to share usernames or passwords with any other person/s. ETB Furniture Limited shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. As the account holder you are responsible for any orders placed on behalf of the organisation you represent when using your account, including payment and signing for delivery. You are also responsible for informing us of any changes to your personal details or the details of your organisation. Account holders must be over 18 years of age.
Electronic communications (e-mails)
When you use our website and send e-mails to us you are communicating with us electronically. By doing this you consent to receive e-mails from us in return and agree that these electronic communications are the equivalent to written communication and therefore would satisfy any legal requirement that such communication be in writing.
You are responsible for any content sent by your computer to ETB Furniture Limited’s e-mail addresses. You must not send e-mails which cause annoyance or inconvenience, or that impersonates another person or entity, or contains content which misleads ETB
Furniture Limited or its staff. Any communications sent by you must not contain viruses or include content which is considered:, Disruptive, offensive or abusive, illegal or fraudulent, obscene or ‘Spam’.
Damage to your computer
ETB Furniture Limited makes every effort to ensure this website is free from viruses or defects. However, we cannot guarantee that your use of the Website or any websites accessible through it won’t cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. ETB Furniture Limited shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using the Website.
Viruses, hacking and other offences
You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which our site is stored or any server, computer or database connected to the Website. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. We reserve the right to make any changes to this website and/or terms and conditions without notice. You will be subject to the current terms and conditions at the time of your order, with the exception of any changes that are required by law or government authority which will be applicable to any orders placed at any time past, present or future.
Should we deem any of the terms and conditions void or unenforceable, it will be severed from all other conditions, and will not affect the validity and enforceability of all other conditions.
We make no assurances that our website will meet your requirements and we cannot be responsible for any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use, or any loss of content or material uploaded, posted or transmitted via it or any websites linked to it.

Our products, services and website have been created for the purpose of contract sales direct to the client. Should a business choose to purchase products for re-sale or for use in other ways than what the item was designed or intended for, we will not be responsible for any losses of profit, business, revenue, contracts, reputation, data, goodwill, anticipated savings, wasted expenditure, management or office time or any other consequential loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

The use of any material content or information in this website is strictly prohibited. All intellectual property rights, trademarks and other content including, software, script, information, logos, images, audio, text, pricing and graphics are the property of ETB Furniture Limited or its affiliates and is protected by English copyright law.
With the exception of links to our homepage from websites deemed suitable and of use or interest to our customers, our consent is required before you copy, download, sell or reproduce any content including logos, for the purpose of publishing, use in other websites, databases or any other commercial activity.
Any unauthorised use of this site or its content terminates the permission granted by ETB Furniture Limited for use.
Waiver
Should you breach these terms and conditions and we choose not to take action, we reserve the right to still use our rights in any other situation where these conditions are breached.
